【EN】Terms and Conditions
These Terms and Conditions (these “Terms”) and any Individual Agreements are prepared in Japanese, and the Japanese language shall govern. Any translation into another language, including this English translation, is provided for reference purposes only and shall not be binding on the parties. In the event of any inconsistency or discrepancy between this English translation and the Japanese version, the Japanese version shall prevail.
For purposes of this English translation, “Company” means FirstJoy Inc. (株式会社楽一番; corporate number 5011101064713), whose registered office is at 8-1-2 Nishi-Shinjuku, Shinjuku-ku, Tokyo. “Rakufun” and “樂淘一番” are brand names operated by the Company and do not refer to separate legal entities.
Article 1: Description of the Service
1.1 (Nature of the Service)
The Service is a service under which the Company purchases products offered by third-party sellers in Japan (including sellers on e-commerce sites and sellers on other third-party platforms; “Domestic Sellers”) and sells such products to Users. Information concerning such products is posted by third parties and may contain deficiencies or involve risks. The Company will establish an appropriate monitoring system and endeavor to protect the rights and interests of Users; however, due to the volume of information and the nature of the online environment, the Company is unable to individually verify the quality, safety, truthfulness, legality, or validity of products and services. Users shall verify the truthfulness and legality of such information at their own discretion and responsibility.
1.2 (Users’ Rights of Use)
Users may purchase from the Company products offered by Domestic Sellers on the Service. In addition, the Company provides value-added services, such as paid package reinforcement services, at the User’s election.
1.3 (Transaction Structure)
The Service is a service under which, in response to a User’s offer to purchase a product, the Company purchases the product offered by a Domestic Seller and sells it to the User.
1.4 (Other Services)
Users may participate in the campaigns and events specified by the Company, and the Company provides various services to Users.
1.5 (Details of the Service)
The specific details and procedures of the Service are set forth in “Payments & Shipping.”
Article 2: User Eligibility
2.1 (Account Registration)
To use the Service, a User must create an account in the User’s own name. A User may use the Service once the User has agreed to these Terms and the Company has approved the User’s registration application.
2.2 (Eligibility to Use the Service)
Users shall have reached the age of majority and shall have the capacity to act under the Civil Code of Japan. A person under 18 years of age may use the Service only with the consent, and under the supervision, of a parent or guardian.
If a User is an adult ward, a person under curatorship, a person under assistance, or any other person who, under the Civil Code of Japan or other laws and regulations, requires consent, representation, or permission to use the Service or to enter into any contract relating to the Service, such User shall use the Service only after obtaining the necessary consent, representation, or permission in accordance with such laws and regulations. Users further warrant that they are not subject to international sanctions, export controls, or similar measures, and that they do not provide funds, goods, services, or technology to any person subject to such measures. If the foregoing is not true, the User may not use the Service.
2.3 (Management of Registration Information)
Users are responsible for the truthfulness, legality, and validity of their registration information. Users shall manage their own account and password and are responsible for all acts performed using them. If unauthorized use is suspected, the User shall promptly notify the Company and, where necessary, report the matter to the police. The Company will respond to the extent reasonable but shall not be liable for any loss or damage incurred before such response.
2.4 (Identification of the Same User)
Multiple accounts registered using the same telephone number, device, e-mail address, payment account, delivery address, or the like may, at the Company’s discretion, be deemed to belong to the “same User.” The Company is entitled to consolidate the benefits (such as coupons and points) of such accounts.
In addition, the Company may request a User to submit identity verification documents where unauthorized use by the User (such as use in a third party’s name or impersonation) is suspected, where necessary to respond to a payment dispute or any other dispute with the Company, or where otherwise necessary for legal or compliance purposes.
2.5 (Account Deletion)
A User may submit an account deletion request via “Account → Setting → Company & Policies → Delete Account” in the app. Upon submission of the request, the system will automatically verify whether the deletion conditions are met and will delete the account immediately. Deletion cannot be reversed. After deletion, the Company will retain personal information to the extent required by laws and regulations and will delete or anonymize all other personal information. The detailed conditions for account deletion are as set forth in the “User Account Deletion Policy” (Appendix).
Article 3: Orders
3.1 (Formation of Orders)
After registering for the Service, Users may order products through the Service. Users shall have the capacity to hold rights and the capacity to act required to purchase products. A person under 18 years of age may use the Service only with the consent, and under the supervision, of a parent or guardian. By placing an order, a User is deemed to satisfy these requirements.
3.2 (Presentation of Summary and Formation of Contract)
Product information, prices, and other information displayed on the Service constitute an “invitation to make an offer,” not an “offer.” The details entered by a User when placing an order (such as quantity, bid price, recipient information, and delivery address) are treated as an “offer” made to the Company.
The Company will determine whether to accept the offer based on a comprehensive assessment of factors such as whether the product is currently on sale or listed and whether the transaction is legitimate. If the offer is not accepted, the Company will refund in full any amount already paid.
3.3 (Out-of-Stock Products, Display Errors, etc.)
If an ordered product is out of stock or its price is displayed incorrectly, the Company may cancel the order before delivery. A User may also cancel the order. If payment has already been made, the Company will refund the full amount.
Article 4: Payment and Delivery
4.1 (Payment)
Users shall pay the purchase price online in accordance with the instructions on the payment screen. A User may not request the delivery of products or the provision of services before payment has been completed or before the Company has accepted the User’s offer.
4.2 (Delivery)
The Company will deliver purchased products to the address designated by the User. Any delivery date displayed is an estimate only, and arrival by that date is not guaranteed. The Company may outsource delivery operations to third-party service providers. Users may not designate the provider to which delivery operations are outsourced.
4.3 (Fees)
Users shall pay the Company the product price, the Service usage fees, and actual expenses to be borne by the User, such as international shipping costs.
4.4 (Delivery Delays and Force Majeure)
The Company shall not be liable for any delay in delivery or any failure of delivery arising from any of the following:
• Errors in information entered by the User
• Absence at the time of delivery
• Changes in the prevailing situation
• Force majeure events, such as natural disasters, government orders, accidents, strikes, and war
4.5 (Damage upon Receipt)
If a product is damaged or any contents are missing upon receipt, the User must inform the delivery person on the spot and have the damage or shortage recorded on the delivery slip. If no such record is made, the delivery will be deemed to have been completed normally, and no compensation procedure will be available.
Article 5: Refund Rules
5.1 (No Returns or Exchanges)
No returns, refunds, or exchanges of purchased products for the User’s own reasons will be accepted by the Company or through the Service.
5.2 (Differences from Product Images)
Product images on the Service website are reference images reproduced from photographs posted by Domestic Sellers. Differences in color, size, or other attributes do not constitute grounds for a return.
5.3 (Cases in Which a Refund May Be Requested)
A User may request a refund in any of the following cases:
• The product could not be purchased due to force majeure or similar circumstances
• A change to the terms of the contract becomes necessary and the User does not accept the change
5.4 (Refund Method)
Refunds under Section 5.3 will be made to the original payment method.
5.5 (Points and Coupons)
When a refund is made, any points, coupons, or similar benefits used will, in principle, be returned subject to their original terms. If they have expired or in similar cases, they will lapse and will not be reissued.
Article 6: Risk Disclosure
6.1 (Nature of the Service)
A User makes an offer to the Company to purchase a product, and a sales contract is formed between the Company and the User. In response to the User’s offer, the Company purchases the product offered by a Domestic Seller and sells it to the User.
6.2 (Quality and Authenticity)
The Company does not guarantee the quality or authenticity of products. Upon a User’s request, the Company may notify the relevant Domestic Seller of the details of such request. However, if the Company incurs liability for non-conformity with the contract with respect to the quality or authenticity of a product, the Company will, at the User’s request, reduce the price or provide a refund.
6.3 (Inspection by the Company)
The Company will inspect products to a reasonable extent according to the type of product (such inspections do not include authentication). The opening of product boxes, power-on checks, and similar procedures will be carried out by the Company to the extent necessary according to the type of product and the inspection method.
6.4 (Language of Labeling)
A product may bear instructions and labels in Japanese only, without an accompanying translated document. Even in such cases, the Company has no obligation to provide a translation unless otherwise agreed. Before using a product, the User shall personally review the instruction manual, directions for use, safety precautions, and other relevant information, and the Company shall not be liable for any loss or damage resulting from misuse or the like, except in cases of willful misconduct or gross negligence on the part of the Company.
6.5 (Personal Use)
Products shall be purchased for personal use, and purchases for the purpose of resale are prohibited.
6.6 (Overseas Standards)
Products are sold for the Japanese domestic market and are manufactured and sold in accordance with standards based on Japanese laws and regulations. Product specifications, voltage, plug type, frequency, wireless communication standards, language of labeling, safety standards, and other technical conditions may differ from the standards applicable in the User’s location. Before purchase, the User shall personally confirm whether the product may be lawfully imported, possessed, and used in the User’s country or region, and the Company shall not be liable for the User’s importation, possession, or use of a product, except in cases of willful misconduct or gross negligence on the part of the Company. The User bears the associated risks.
6.7 (Export Procedures)
The Company will carry out, in its own name, the procedures for exporting products outside Japan to the User. The Company may restrict or refuse the purchase or export of a product due to Japanese export regulations, transport regulations, import regulations of the destination country, or the like, and, except in cases of willful misconduct or gross negligence on the part of the Company, the Company shall not be liable for any loss or damage incurred by the User as a result. Ownership of a product will pass to the User when the product is handed over to the carrier engaged by the Company.
6.8 (Export Costs)
Costs relating to export outside Japan and related matters shall be borne by the User.
Article 7: Prohibited Acts
7.1 (Prohibited Conduct)
In using the Service, Users shall act in good faith and in an appropriate manner and shall not engage in any of the following acts:
• Using the Service for a wrongful or improper purpose
• Registering multiple accounts on a duplicative or malicious basis
• Using the address of the Company’s head office, warehouse, or any other location managed by the Company to obtain a credit card, telephone number, or the like, or to apply for any other service
• Obtaining coupons or points by improper means, converting coupons or points into cash, reselling them, engaging in sham transactions, or similar acts
• Infringing the intellectual property rights, right to reputation, portrait rights, or other rights of the Company or any third party
• Fraud or any other criminal act
• Using the Service by impersonating a third party
• Any act that violates laws and regulations or these Terms
7.2 (Measures by the Company)
If a User violates Section 7.1, the Company may take any of the following measures without the User’s consent:
• Freezing the User’s account
• Canceling orders
• Temporarily suspending or terminating the User’s use of the Service
7.3 (Compensation for Loss or Damage)
If the Company suffers any loss or damage as a result of a User’s violation, the User shall compensate the Company for the full amount of such loss or damage. If unlawful conduct is identified, the Company may report it to the relevant authorities.
If the Company causes loss or damage to a User for reasons attributable to the Company, the Company shall be liable to compensate the User up to the purchase price of the relevant product, except in cases of willful misconduct or gross negligence on the part of the Company. However, where mandatory consumer protection laws of the User’s location apply, such laws shall govern.
Article 8: Privacy Policy
The Service attaches importance to the protection of Users’ personal information. Users agree that their personal information will be collected, stored, used, disclosed, and protected in accordance with the Privacy Policy published by the Company. Users are requested to review the Privacy Policy in advance and fully understand its contents before using the Service.
Article 9: Warranty and License Regarding Non-Personal Information
9.1 (Publication of Information)
Users warrant that they hold lawful and full rights to any information they publish on the Service. The Company may delete any information published by a User, or remove it from public view, in accordance with laws and regulations or these Terms.
9.2 (Prohibited Information)
Users shall not publish any information that contains any of the following:
• Content that violates laws or regulations
• Inappropriate content, such as political propaganda, superstition, obscenity, violence, or the promotion of crime
• False or misleading content
• Content that infringes the intellectual property rights, trade secrets, or similar rights of others
• Defamation, insults, invasion of privacy, or the like
• Harmful programs, such as viruses, malware, and spyware
• Content contrary to public order and morals, or content that the Company determines to be inappropriate
Article 10: Intellectual Property Rights
10.1 (Users’ Responsibility)
Content (such as text, images, and videos) that a User posts, stores, or transmits on the Service shall be limited to content in which the User holds the copyright or for which the User has lawfully obtained a license.
10.2 (License)
By using the Service, a User is deemed to have granted to the Company’s affiliates a license to use the content the User posts on the following terms:
• Non-exclusive
• Royalty-free
• Perpetual
• Worldwide
• Transferable
• Irrevocable
The Company may use such content for any purpose, including commercial purposes, and may sublicense it to third parties as necessary.
10.3 (Enforcement of Rights)
The Company and its affiliates may, at their own discretion, enforce rights against any infringement of a User’s content (including by issuing warnings or bringing litigation or arbitration) and may receive any damages obtained as a result.
Article 11: Amendment and Termination of These Terms
11.1 (Amendment of These Terms)
The Company may amend these Terms from time to time as necessary in light of amendments to laws and regulations or for the operation of the Service. The amended Terms will be published on the Service and will take effect upon publication. If a User does not agree to an amendment, the User is requested to cease using the Service. If a User continues to use the Service after an amendment, the User will be deemed to have agreed to the amendment.
11.2 (Termination of These Terms)
These Terms will terminate in either of the following cases:
• The Company deletes the User’s account
• The Company ceases to provide the Service
11.3 (Effect of Termination)
After termination of these Terms, the Company shall have no obligation to the User, such as any obligation to provide the Service or disclose information.
Article 12: Severability
If any part of these Terms is or becomes invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Article 13: Governing Law and Jurisdiction
13.1 (Governing Law)
These Terms shall be governed by the laws of Japan with respect to their formation, validity, interpretation, performance, and dispute resolution. However, this shall not apply where mandatory consumer protection laws of the User’s location apply.
13.2 (Jurisdiction)
The Tokyo District Court or the Tokyo Summary Court, depending on the amount in controversy, shall have exclusive jurisdiction by agreement over any dispute relating to the Service or these Terms. However, this shall not apply where mandatory consumer protection laws of the User’s location apply.
Article 14: Appendix – User Account Deletion Policy
Before deleting your account, please carefully read, understand, and agree to the following.
If you have any questions regarding this User Account Deletion Policy, please contact our online customer service or email us at service@leyifan.com.
Please note again that, once you delete your account, the Company will cease to provide services to you, and considerable inconvenience will arise in connection with after-sales service and procedures for protecting your rights.
Once the deletion is complete, the Company will delete your personal information from the front-end system so that it cannot be searched or accessed, or will anonymize it.
You are deemed to understand that, under applicable laws and regulations, transaction records must be retained in Rakufun’s back-end system for three years or longer.
If you still wish to delete your account, your account must satisfy all of the following conditions:
1. There are no incomplete orders in the account
2. There are no ongoing disputes (such as complaints, reports, or reports made by others)
3. All linked logins and connections with other websites and apps have been removed
If, during the account deletion process, your account becomes involved in a dispute (such as a complaint, report, lawsuit, arbitration, or investigation by a government authority), Rakufun is entitled to discontinue the deletion process without your consent.
Before submitting a deletion request, be sure to unlink your account from all other services. For details, please contact customer service.
A deleted account cannot be restored. Before proceeding with account deletion, be sure to back up all information and data relating to your account yourself.
Once your account is deleted, you will no longer be able to use it, and you will not be able to recover any content or information in or relating to the account (even if you re-register using the same phone number), including but not limited to the following:
1. You will no longer be able to log in to or use the account
2. Your personal information and history in the account (such as username, nickname, profile icon, and purchase history) cannot be restored
3. Records of logins to Rakufun’s affiliated websites and apps made through the account cannot be restored
In addition, because you will no longer be able to log in, any coupons, points, and other cards you have obtained will automatically be deemed to have been relinquished and can no longer be used. Rakufun will not be able to restore them.
Deletion of your account does not exempt you from, or reduce, any liability relating to activities conducted through your account before deletion.
